These General Terms and Conditions of Sale ("GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("the Clients" or "the Client") wishing to purchase the products offered for sale ("the Products") by the Seller on the website https://inopinelatelier.com.

ARTICLE 2 – Purpose

These General Terms and Conditions of Sale govern the sale of handmade products and workshop services offered on the website https://inopinelatelier.com. They define the rights and obligations of the buyer (hereinafter "the Client") and the seller (hereinafter "Inopiné l’atelier").

ARTICLE 3 – Products and Services Offered

  • Sale of hand-tufted rugs intended for wall or floor decoration.

  • Sale of tufting initiation workshops, scheduled on dates selected at the time of booking.

  • Workshops are open to participants aged 15 and over for safety reasons.

  • Products available for sale are either in stock or available for pre-order (as specified on the product page along with the estimated timeframe).

ARTICLE 4 – Orders

  • Orders are placed exclusively online via the website.

  • Placing an order implies acceptance of the prices and product/service descriptions.

  • In the event of a product being exceptionally unavailable, the Client will be informed as soon as possible.

 

ARTICLE 5 – Pricing and Payment Methods

  • Prices are listed in euros (€), all taxes included (TTC).

  • Shipping costs are calculated automatically based on the shopping cart and displayed before payment.

  • Accepted payment methods: Credit Card and ShopPay.

  • Payment is due immediately upon ordering.

  • Transactions are secured via the payment provider’s SSL protocol.

 

ARTICLE 6 – Delivery

  • Delivery is provided by Colissimo or Mondial Relay.

  • Delivery times:

    • 5 to 7 business days for mainland France

    • Up to 12 business days for the European Union

  • A tracking link is sent by email once the parcel is shipped.

  • If the product is not delivered within 15 business days after the indicative date (except in cases of force majeure or client fault), the Client may request to cancel the sale (Articles L216-2, L216-3, and L241-4 of the French Consumer Code).

 

ARTICLE 7 – Right of Withdrawal & Returns

  • In accordance with legal provisions, the Client has 14 days from receipt of the product to exercise the right of withdrawal.

  • Returns are at the Client’s expense, in the original packaging and in perfect condition.

  • Returned items that are incomplete, damaged, or soiled will not be refunded or exchanged.

  • To exercise the right of withdrawal, the Client may fill out the form at the end of the GTC or send an email to the contact address.

  • Custom-made products are neither refundable nor exchangeable.

Exceptions:

  • No refunds will be issued if the Client fails to attend the reserved workshop.

  • However, it is possible to reschedule or cancel participation up to 96 hours before the scheduled date.

ARTICLE 8 – Legal Warranties

Products benefit from:

  • The legal warranty of conformity (Articles L217-3 to L217-20 of the French Consumer Code)

  • The warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code)
    In the case of a non-compliant or defective product, the Client may request a refund or exchange at no extra cost.

ARTICLE 9 – Personal Data

  • Data collected is necessary for the processing of orders and deliveries.

  • It is handled in compliance with the GDPR (Regulation 2016/679).

  • The data controller is Inopiné l’atelier.

  • The Client has the following rights (by writing to inop.inees@outlook.com):

    • Right of access, rectification, and deletion

    • Right to data portability

    • Right to object

    • Right to lodge a complaint with the CNIL

  • Data is retained for a maximum of 5 years and will not be used for commercial purposes without explicit consent.

ARTICLE 10 – Intellectual Property

All content on the website, including visuals and text, is protected by copyright.
No reproduction is permitted without the prior written consent of the Seller.

ARTICLE 11 – Governing Law & Disputes

These GTC are governed by French law.
In case of a dispute, an amicable resolution will be sought first.
Failing that, the competent court will be seized.

ARTICLE 12 – International Sales

Delivery times outside France may vary depending on the destination.
Clients are encouraged to contact us for further information before placing an order.
